Phoenix Construction Lawyers

You are in a tough business. You need experienced, responsive Phoenix construction attorneys who know your industry.

Construction Law

For Phoenix-area contractors, subcontractors, construction suppliers and project owners, dealing effectively with construction-related Arizona legal issues is essential to your success and freeing you to focus on running a profitable business. (See some of our recent results for our construction clients.)

Contractors depend on the industry-specific experience and skill of our Phoenix construction lawyers in a wide variety of areas, ranging from construction litigation and licensing issues to bond claims, dust control compliance and opportunities for green building. You may also benefit from our experience in helping financially distressed construction companies position and structure themselves for future viability, licensing and profitability.

ROC Licensing and Complaints

Arizona contractors depend on our many years of experience in a broad range of Arizona Registrar of Contractors matters, including licensing (new and renewal), license denials and complaints. We can represent you in appealing a suspended or revoked license, help you resolve the issues that led to the discipline, and restore your license to good standing.

Collections and Lien Enforcement

We help contractors preserve their payment rights, through our collection experience and online resources pertaining to mechanics' and materialmen's liens, bond claims, stop notices and the Arizona Prompt Payment Act.

Construction Litigation

We have a long-standing tradition of resolving complex construction disputes and related issues (see our Results page) involving subcontractors, general contractors, suppliers, lenders, state and local governments, property owners and developers. Our construction litigation background includes contested matters related to:

Wage & Hour and Worker Safety

We represent employers in workplace safety investigations by the Occupational Safety and Health Administration (OSHA) and the Arizona Division of Occupational Safety and Health (ADOSH); challenges of workers' compensation claims; and wage and hour investigations of contractors by the U.S. Department of Labor. We can also advise contractors working on federal project in complying with the Davis-Bacon Act.

Dust Control in the Phoenix Area

If a contractor receives a Notice of Violation, we can arrange for independent testing to challenge the inspector’s findings. An effective challenge can mitigate the fine, and in some cases cause the Notice of Violation to be dismissed. We can protect you from being steamrolled by the County and make sure your rights are protected. If the case goes to a hearing, we present testimony and other evidence that we believe will get the best possible result.

Solar Construction

As with all types of construction and installation, the Arizona Registrar of Contractors requires that solar contractors are properly licensed. In general, a contractor must qualify as a solar contractor to install, alter or repair a solar device, and must hold the license that is appropriate to the type of solar device being installed.

Green Building

Lang & Klain’s Phoenix construction lawyers help Arizona contractors and subcontractors profit from green building opportunities. Our green building services include drafting of green construction contracts, assistance in obtaining LEED certification and complying with LEED prerequisites, representation in LEED certification challenges, and complying with other green building standards.
